Introduction

LUAS Resource Alteration Activities are subject to Section 43 of the LUAS Enactment 1999 which describes the powers of the Director over flood zones, river reserves, protection zones, water bodies and coastal waters.

LUAS as an agency whose role is to take care of water resources in the state of Selangor has made it mandatory for the application for Written Permission by any developer to be submitted and approved before a project related to water resources is carried out. This Written Permission is very necessary in emphasizing the environmental care of water resources in the State of Selangor.

The following is a List of Resource Modification Activities.

LUAS Function

The role of the Board in granting Written Permission is as follows:

  1. To ensure the quality of river water is always preserved;
  2. Minimize the impact of pollution on water resources during construction works;
  3. Facilitate the Board to monitor developers who carry out construction work involving water resources;
  4. Enforcing the Selangor Water Management Board Enactment 1999;
  5. Provide awareness to stakeholders on their respective roles in water resource conservation; and
  6. Cultivate an attitude of responsibility, love and respect for the importance of preserving the river among developers.

Control of Resource Alteration Activities under Section 43 of the Selangor Water Management Board Enactment 1999. The Resource Alteration Activities (Selangor) Regulations 2013 were gazetted under this Section on 10 October 2013 and came into effect on 11 October 2013

Application For Source Alteration Activities

Written Permission Application Guide

  1. Registration of new users on the elesen.luas.gov.my website. Select the Written Permission System. Users can refer to the included Written Permission System User Manual. (The name of the registered company is the name of the licensee and it is recommended that the developer company be the licensee for non -government projects)
  2. Applicants are required to log in to the elesen.luas.gov.my website after receiving the confirmation email.
  3. Applicants are required to make a new application/renewal of Written Permission for Source Alteration Activities.
  4. In case of New Application and Late Renewal, please make a registration fee of RM150 at the Board office.
  5. Applicants are required to submit the required documents as per the Checklist to the Board within 7 days.
  6. Applicants will receive a notification via email if the information needs to be updated or the application fails.
  7. For applications that have been approved, a Written Permission Fee of RM200 must be submitted to the Board for the issuance of Written Permission.

Note: Payment must be made in cash or crossed check in the name of "SELANGOR WATER MANAGEMENT BOARD". Payment operating hours are as follows:

Monday – Thursday : 8.30 am – 3.30 pm

1.00 pm - 2.00 pm (time break)

Friday : 8.30 am – 3.30 pm

12.15 pm - 2.45 pm (time break)

Policy Approval Application Guide for Jetty/Platform Construction

  1. Application for Construction/Making/Erection/Maintenance/Use of this Jetty must be filled by the operator or operator of any jetty on any river reserve/flood zone/protection zone/buffer zone.
  2. Applicants are required to submit an application according to the Jetty/Platform Policy Approval Checklist (U016-L5-005-00). An Application Form (U016-F4-006-00) is representative of a jetty.
  3. The application will be presented in the Selangor State Jetty Management Committee.
    If passed, the applicant must submit an application for Written Permission for the construction of the jetty. Refer to the Written Permission Application Guide.
  4. Approved jetty owners are required to submit load records every 3 months to the Board after the jetty is completed. Refer to the Load Monitoring Record Form for Goods Transported Using Jetty (U016-F4-007-00).
  5. Approved jetty owners are required to make payments annually to carry out jetty activities based on the jetty activity charge schedule.

Water Resource Abstraction

INTRODUCTIONThe consumption and water intake from any source found on the ground surface or underground (groundwater).‘Groundwater’ means subsurface water found below the water level in soils and geologic formations and includes: a. A well, borehole or similar form of work excavated into the underground strata, including any  or channel constructed in connection with the well, borehole or form of work to facilitate the collection of water in the well, borehole or form of work.b. Any excavation into an underground of strata where the water level in the excavation depends entirely or largely on the water entering it from that strata; andc. Any designated groundwaterROLE/FUNCTION OF LUAS1. Lembaga Urus Air Selangor (LUAS) through the Selangor state government is the body responsible for managing water resources under the Selangor Water Management  Board Enactment 1999;To carry out supervision and control over the use and flow of water in any water source and whether it occurs naturally on the surface or subsurface of the land. Section 41 (1)2.  Given that LUAS is responsible for controlling the use of water resources, then;No person or public authority shall, except with the approval of LUAS, interfere with the natural flow of water in any water source or take or use water from any water source except in a certain amount that has been authorized by LUAS from time to time. Section41 (2)3.  Control over the use of water resources is made through;Grant licenses on conditions deemed appropriate by LUAS to any public authority or person to undertake any activities relating to water resources and to regulate licensees and their activities. Section 6 (1) (n) Imposing charges on the use of water or any other source from any water source including but not limited to the abstraction, production, disposal, drainage, diversion and siege of that water or other source. Section 44 (1) (a)4.  If found;Any person who, without the approval of LUAS extracts, uses or diverts water or other sources of water shall be guilty of an offense and shall on conviction be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both. Inland Waterway Navigation

Discharge of Return Water, and Entry or Discharge of Waste and Pollutants

IntroductionIn line with the Selangor Plan 1 (RS-1) in the focus sector of 'Water Management' under Strategic Theme 3:Driving Sustainability, the Selangor State Government through the Selangor Water Management Authority (LUAS) has taken the initiative to introduce and implement the Zero Discharge Policy (ZDP) which focuses on managing and regulating the quantity and quality of water resources from environmental sources.This ZDP approach is enforced through the formulation of new regulations under the 1999 LUAS Enactment, namely the Discharge of Return Water, and Entry or Discharge of Waste and Pollutants (State of Selangor) Licensing Regulations 2024 where this regulation is an improvement to the enforcement of existing regulations as well as replacing existing regulations there is the Emission or Discharge of Pollutants (State of Selangor) Regulations 2012.The proposed implementation of this ZDP is a commitment by the Selangor State Government in improving the quality of water resources, especially in the main river basins in the State of Selangor. This new regulation was approved by the Selangor State Government through the meeting of the Selangor State Government Meeting Council (MMKN) Bill 14/2024 on 15 May 2024 and was gazetted on 20 June 2024 for use in force throughout the State of Selangor.A total of 13 scheduled activities  that include all activities in the environment of water sources and river basins (near or far from water sources/rivers) have been set in the Discharge of Return Water, and Entry or Discharge of Waste and Pollutants (State of Selangor) Licensing Regulations 2024 as follows :Freshwater, brackish and relevant premises only have to pay a set rate for return water and effluent released to water sources.Ensuring compliance with the quality standard limits set for the release of return water and effluent into water sources and the environment based on methods that are compatible with the latest technology used by the premises.Encouraging the premises to apply Best Management Practice (BMP) in an effort to reduce operating costs by implementing methods of reuse and recycling of wastewater at the same time minimizing to zero discharge to reduce the impact on water resources.As one of the initiatives in the form of contribution and involvement of all parties involved in the management of water resources which will be reused by the Selangor State Government through Selangor Water Management Authority (LUAS) for the development, preservation and conservation of the state's water resources.Ensuring that every premise that is subject to the 13 scheduled activities under this Regulation needs to obtain a Return Water Discharge License (AK) as well as a Waste and Pollutant Entry or Release License (BP).Ensuring that premises that have been licensed are required to comply
