Introduction

LUAS Resource Alteration Activities are subject to Section 43 of the LUAS Enactment 1999 which describes the powers of the Director over flood zones, river reserves, protection zones, water bodies and coastal waters.

LUAS as an agency whose role is to take care of water resources in the state of Selangor has made it mandatory for the application for Written Permission by any developer to be submitted and approved before a project related to water resources is carried out. This Written Permission is very necessary in emphasizing the environmental care of water resources in the State of Selangor.

The following is a List of Resource Modification Activities.

LUAS Function

The role of the Board in granting Written Permission is as follows:

  1. To ensure the quality of river water is always preserved;
  2. Minimize the impact of pollution on water resources during construction works;
  3. Facilitate the Board to monitor developers who carry out construction work involving water resources;
  4. Enforcing the Selangor Water Management Board Enactment 1999;
  5. Provide awareness to stakeholders on their respective roles in water resource conservation; and
  6. Cultivate an attitude of responsibility, love and respect for the importance of preserving the river among developers.

Control of Resource Alteration Activities under Section 43 of the Selangor Water Management Board Enactment 1999. The Resource Alteration Activities (Selangor) Regulations 2013 were gazetted under this Section on 10 October 2013 and came into effect on 11 October 2013

Application For Source Alteration Activities

Written Permission Application Guide

  1. Registration of new users on the elesen.luas.gov.my website. Select the Written Permission System. Users can refer to the included Written Permission System User Manual. (The name of the registered company is the name of the licensee and it is recommended that the developer company be the licensee for non -government projects)
  2. Applicants are required to log in to the elesen.luas.gov.my website after receiving the confirmation email.
  3. Applicants are required to make a new application/renewal of Written Permission for Source Alteration Activities.
  4. In case of New Application and Late Renewal, please make a registration fee of RM150 at the Board office.
  5. Applicants are required to submit the required documents as per the Checklist to the Board within 7 days.
  6. Applicants will receive a notification via email if the information needs to be updated or the application fails.
  7. For applications that have been approved, a Written Permission Fee of RM200 must be submitted to the Board for the issuance of Written Permission.

Note: Payment must be made in cash or crossed check in the name of "SELANGOR WATER MANAGEMENT BOARD". Payment operating hours are as follows:

Monday – Thursday : 8.30 am – 3.30 pm

1.00 pm - 2.00 pm (time break)

Friday : 8.30 am – 3.30 pm

12.15 pm - 2.45 pm (time break)

Policy Approval Application Guide for Jetty/Platform Construction

  1. Application for Construction/Making/Erection/Maintenance/Use of this Jetty must be filled by the operator or operator of any jetty on any river reserve/flood zone/protection zone/buffer zone.
  2. Applicants are required to submit an application according to the Jetty/Platform Policy Approval Checklist (U016-L5-005-00). An Application Form (U016-F4-006-00) is representative of a jetty.
  3. The application will be presented in the Selangor State Jetty Management Committee.
    If passed, the applicant must submit an application for Written Permission for the construction of the jetty. Refer to the Written Permission Application Guide.
  4. Approved jetty owners are required to submit load records every 3 months to the Board after the jetty is completed. Refer to the Load Monitoring Record Form for Goods Transported Using Jetty (U016-F4-007-00).
  5. Approved jetty owners are required to make payments annually to carry out jetty activities based on the jetty activity charge schedule.

Water Resource Abstraction

INTRODUCTIONThe consumption and water intake from any source found on the ground surface or underground (groundwater).‘Groundwater’ means subsurface water found below the water level in soils and geologic formations and includes: a. A well, borehole or similar form of work excavated into the underground strata, including any  or channel constructed in connection with the well, borehole or form of work to facilitate the collection of water in the well, borehole or form of work.b. Any excavation into an underground of strata where the water level in the excavation depends entirely or largely on the water entering it from that strata; andc. Any designated groundwaterROLE/FUNCTION OF LUAS1. Lembaga Urus Air Selangor (LUAS) through the Selangor state government is the body responsible for managing water resources under the Selangor Water Management  Board Enactment 1999;To carry out supervision and control over the use and flow of water in any water source and whether it occurs naturally on the surface or subsurface of the land. Section 41 (1)2.  Given that LUAS is responsible for controlling the use of water resources, then;No person or public authority shall, except with the approval of LUAS, interfere with the natural flow of water in any water source or take or use water from any water source except in a certain amount that has been authorized by LUAS from time to time. Section41 (2)3.  Control over the use of water resources is made through;Grant licenses on conditions deemed appropriate by LUAS to any public authority or person to undertake any activities relating to water resources and to regulate licensees and their activities. Section 6 (1) (n) Imposing charges on the use of water or any other source from any water source including but not limited to the abstraction, production, disposal, drainage, diversion and siege of that water or other source. Section 44 (1) (a)4.  If found;Any person who, without the approval of LUAS extracts, uses or diverts water or other sources of water shall be guilty of an offense and shall on conviction be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a term not exceeding two years or to both. Inland Waterway Navigation

Emission Or Discharge of Pollutants

IntroductionThe Selangor State Government through the Selangor State Assembly has gazetted the Regulations - Regulations on the Entry or Release of Pollutants (State of Selangor) 2012 on 19 April 2012.A press release regarding the gazetting of this Regulation was made by the Selangor Water Management Authority (LUAS) on 10 June 2012 which is effective from 20 April 2012 and only applies in the State of Selangor all seven (7) scheduled activities under the Regulation are required to obtain a License from LUAS. to regulate the release of pollutants from such activities.Each such scheduled activity will only be subject if its quantity and description fall below the specified scope. Any release of pollutants from such activities into water sources must comply with the limits of the standards that have been set. Any non -compliance will be subject to the prescribed charges and penalties.Each license is issued annually and is subject to the registration fee and license fee that has been set.Regulatory Requirements:Obtaining a Pollutant Entry or Release License.Determine the final release point on the premises.Effluent analysis report every three (3) months.Analysis by an accredited laboratory.Ensure effluent discharge does not exceed standard limits.LUAS FunctionEach scheduled activity is subject to these Regulations and must obtain a LUAS Pollutant Entry Or Release License.Premises that have been licensed are not allowed to discharge effluent from the premises in excess of the limits of the standards that have been set.For premises that are not subject to the rules, it is also required to ensure that the effluent discharged does not exceed the standard limits that have been set. If it is found that the premises fail to comply with the set standards, the Board may issue a Notice of Instruction to the premises for the purpose of cleaning works, mitigation measures and improvements according to the situation and level of pollution cases in accordance with Section 41 (4), 43 (2) , 96 (4) and 121 (1), LUAS Enactment 1999.Inspection of compliance with the license conditions will be conducted by the Board and if there is a violation of the permitted parameter limits for each scheduled activity by the applicant or premises, the Board reserves the right to impose:Collision charges.License revocation.Compound.ProsecutionPower SourceIt is based on Section 79, Selangor Water Management Board Enactment 1999, namely:Section 79. Prohibition of pollution of a water source79. (1) Except as expressly permitted in any written law no person, except under and in accordance with the terms and conditions of a license issued under this section, causes entry or discharge into in any water source;(a) any toxic, harmful or pollutant substance or waste which will cause or is likely to cause or contribute to the occurrence of a water source or part thereof endangering, deteriorating or affecting the health, safety or welfare of the public or the life or health of animals or plants or on or against other beneficial uses of the water resource;(b) any substance which by reason of its heat, biological or chemical content or its effect changes the color of water makes or contributes to making the water source or part thereof potentially endangering the health, safety or public welfare or the life or health of animals or plants or affecting its use other beneficial sources of the water;(c) any substance which by reason of its physical condition, chemical or biological content, or the effect of changing the color of water makes or contributes to making the water source difficult to recover or affecting the flow, quality or quantity of water in the water source; and(d) oil in any form, used oil, waste or waste material containing oil or otherwise.(2) When any such entry or discharge has been made, the owner or occupier of the property from which the entry or discharge originates shall, unless the contrary is proved, be deemed to have discharged or caused its entry into the water source.(3) A license to insert or discharge into any water source any of the substances mentioned in subsection (1) may be granted by the Board pursuant to Section 59.(4) A person who contravenes this section shall be guilty of an offense and shall on conviction be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment not exceeding three years or to both and to a further fine of five thousand.Fees and ChargeBil.DescriptionFees1.Registration Fee (One-Off Only)RM1502.License Fee (Annually)RM650APPLICATION FOR ENTRY AND RELEASE OF POLLUTANTSThe Selangor Water Management Authority (LUAS) has started implementing the online Pollutant Entry or Release License application from 1 July 2018.Every new application / renewal of Pollutant Entry or Release License must go through the Effluent Licensing System (LEDS).Application can be made by following the steps as follows:Visit the elesen.luas.gov.my websiteClick New User Registration (for new users).Log in then click the LEDS icon.APPLICATION FORMNo forms are to be used.
