Introduction

In line with the Selangor Plan 1 (RS-1) in the focus sector of 'Water Management' under Strategic Theme 3:

Driving Sustainability, the Selangor State Government through the Selangor Water Management Authority (LUAS) has taken the initiative to introduce and implement the Zero Discharge Policy (ZDP) which focuses on managing and regulating the quantity and quality of water resources from environmental sources.

This ZDP approach is enforced through the formulation of new regulations under the 1999 LUAS Enactment, namely the Discharge of Return Water, and Entry or Discharge of Waste and Pollutants (State of Selangor) Licensing Regulations 2024 where this regulation is an improvement to the enforcement of existing regulations as well as replacing existing regulations there is the Emission or Discharge of Pollutants (State of Selangor) Regulations 2012.

The proposed implementation of this ZDP is a commitment by the Selangor State Government in improving the quality of water resources, especially in the main river basins in the State of Selangor. This new regulation was approved by the Selangor State Government through the meeting of the Selangor State Government Meeting Council (MMKN) Bill 14/2024 on 15 May 2024 and was gazetted on 20 June 2024 for use in force throughout the State of Selangor.

A total of 13 scheduled activities that include all activities in the environment of water sources and river basins (near or far from water sources/rivers) have been set in the Discharge of Return Water, and Entry or Discharge of Waste and Pollutants (State of Selangor) Licensing Regulations 2024 as follows :

  1. Freshwater, brackish and saltwater aquaculture.
  2. Poultry farming.
  3. Ruminant farming.
  4. Animal husbandry.
  5. Washing of rock material.
  6. Slaughterhouse.
  7. Recreation.
  8. Development or earthworks.
  9. Common sand mining.
  10. Industry.
  11. Sewage treatment services
  12. Solid waste management services.
  13. Water supply service.
LUAS Function
  1. Selangor Water Management Authority (LUAS) will ensure that the implementation objectives of this ZDP are implemented and among the objectives of the ZDP are: :

    1. Encouraging all operators and activity/industry premises to minimize the quantity of effluent discharge based on the Polluters Pay Principle (PPP) where the relevant premises only have to pay a set rate for return water and effluent released to water sources.

    2. Ensuring compliance with the quality standard limits set for the release of return water and effluent into water sources and the environment based on methods that are compatible with the latest technology used by the premises.

    3. Encouraging the premises to apply Best Management Practice (BMP) in an effort to reduce operating costs by implementing methods of reuse and recycling of wastewater at the same time minimizing to zero discharge to reduce the impact on water resources.

    4. As one of the initiatives in the form of contribution and involvement of all parties involved in the management of water resources which will be reused by the Selangor State Government through Selangor Water Management Authority (LUAS) for the development, preservation and conservation of the state's water resources.

  2. Ensuring that every premise that is subject to the 13 scheduled activities under this Regulation needs to obtain a Return Water Discharge License (AK) as well as a Waste and Pollutant Entry or Release License (BP).

  3. Ensuring that premises that have been licensed are required to comply with the license conditions that have been set.

  4. Inspection of compliance with the license conditions will be carried out by Selangor Water Management Authority (LUAS) and if there is a violation of the license conditions that have been set, Selangor Water Management Authority (LUAS) has the right to charge :

    1. Collision charges.
    2. License revocation.
    3. Compound.
    4. Prosecution.

    1. Interpretation:

      ‘Water that is returned or discharged into a water source from any licensed activity’.

  2. WASTE / POLLUTANTS
    1. Interpretation:

      1. Waste: 'Anything released into the environment in any volume, composition or manner that causes pollution'.

      2. Pollutants: 'Anything released, released or placed from any source that can cause pollution to the environment'.

Applications for Discharge of Return Water Licenses and Entry or Discharge for Waste and Pollutants Licenses

For the implementation of the Discharge of Return Water, and Entry or Discharge of Waste and Pollutants (State of Selangor) Licensing Regulations 2024, there are two (2) licenses issued under these regulations, namely:

  1. Discharge of Return Water License (AK)
  2. Entry or Discharge for Waste and Pollutants License (BP)

The Selangor Water Management Authority (LUAS) has started applying for Discharge of Return Water License (AK) and Entry or Discharge for Waste and Pollutants License (BP) online from 1 July 2018.

Every new application / renewal of Discharge of Return Water License (AK) and Entry or Discharge for Waste and Pollutants License (BP) must go through the Licensing of Effluent Discharge System (LEDS).

Applications can be made by following the steps as follows:

  1. Visit the website elesen.luas.gov.my
  2. Click New User Registration (for new users).
  3. Log in.
  4. Click the LEDS icon.
  5. Select the relevant license application, either the AK icon for Discharge of Return Water License or the BP icon for Entry or Discharge for Waste and Pollutants License.
  6. Refer to the User Manual for application matters.
